Those who suspect that their selection for a layoff is discriminatory may be more likely to aggressively pursue a claim if they expect to be jobless for a long time. Employees worried about their jobs may be stressed and edgy, leading to performance issues. Laid off workers and their attorneys may be scrutinizing employer compliance with WARN act and COBRA requirements.
