This report, based in part on information obtained from the DOL via Freedom of Information Act (FOIA) requests, provides several pieces of critical information:
-DOL Assessment. Find out whether the roles and duties performed by the position selected likely would satisfy the new executive, administrative, professionals, computer or outside sales exemption tests.
-DOL Opinion Letters. Receive reference to and copies of any opinion letters (if available), issued by the DOL since Aug. 23, 2004, that discuss application of the new standards to the selected position.
-Federal Court Decisions. If available, obtain reference to and copies of any federal court decisions released since Aug. 23, 2004, that specifically address the exemption status of the classification.
-Other FLSA Overtime Exemptions to Consider. Understand any additional overtime exemptions available under the FLSA that may apply to the selected position.
