California Supreme Court Blurs Discrimination-Harassment Distinction While Limiting Punitive Damages

The California Supreme Court in its recent decision in Roby v. McKesson, No. S149752 (Nov. 30, 2009), concluded that a supervisor's "business and management" actions may be properly considered in determining whether a plaintiff was subject to hostile work environment harassment .
