Seismic changes are occurring in the legal landscape involving lesbian, gay, bisexual and transgender issues. On June 26, 2013, the United States Supreme Court issued its highly anticipated decision in United States v. Windsor , holding that the Defense of Marriage Act ("DOMA") is unconstitutional on equal protection grounds. This decision followed previous expanded protections against sexual orientation and gender identity/expression discrimination at the federal, state and local levels. For example, the EEOC recently expanded its guidance on Title VII's definition of "sex" to include transgender employees. This paper covers important employment and benefits related information to keep employers up to date and avoid potential exposure and liability while dealing with these hot new issues.

Nearly twenty years after passage of the Family and Medical Leave Act of 1993, what steps are employers taking to manage employee absence and help stay compliant with federal and state leave laws? To answer that question, the ADP Research Institute surveyed 503 HR and Benefits decision makers to better understand their business priorities and practices regarding FMLA administration and Total Absence Management (TAM).

Survey results suggest that employer views on Total Absence Management are mixed. Lost productivity due to unplanned absence is a primary business concern for employers; however, few employers reported that they had undertaken studies to measure the impact of absenteeism on productivity or develop strategies to mitigate the side effects of unplanned absence.

Whether your company outsources its absence management, or manages it in-house, if you’re focusing only on leaves that fall under the FMLA, you could be placing yourself at risk for failing to comply with the Americans with Disabilities Act. With the recent amendments to the ADA and increased agency enforcement, employers need to think broadly when administering employee leaves.

The Americans with Disabilities Act Amendments Act, which became in 2009, significantly broadened the scope of the ADA. As a result, more employees qualify as disabled under the ADA and, therefore, are entitled to the ADA’s protections.

David Mohl, Cigna’s Senior Employment Council will explore the intersection of the ADA and FMLA and review best practices that can help employers stay compliant.

Are you one of the employers out there trying to manage the Family and Medical Leave Act (FMLA), state family and medical leaves, the Americans with Disabilities Act (ADA), and company leaves using your time and attendance system? Have you tested this for compliance? While it is true that many time and attendance systems collect information about employee schedules, absence, and in some cases the reason for leave, the compliance landscape is far more complex and requires significantly more information than is typically collected to meet payroll needs.
