Once FMLA expires..are they still protected

Once a employee's FMLA runs out, are they still entitled to come back at their job at the same rate of pay/position (if available)? I don't think they can...but, could they file suit againt the employer?

HI Tammy -

You are not required by federal law to hold their position longer than the 12 weeks, however if you are in california, make sure to check that there are no other curcumstances in California that would allow job protections past 12 weeks (i.e. - pregnancy)
