Hi,

Am I obligated to pay out an employee's paid vacation if they have been fired?

Depends on what your company policy states. The policy that I have found that I like the best states something like "paid time off will be paid out if the company is given 2 weeks notice" and "paid time off will not be paid to employees who give less than 2 weeks notice or are involuntarily terminated"

speaking of which...how about accrued benefits and superannuation contributions...our superannuation contribution is 5% employee and 5% company contribution. is it right to withhold the company contribution from being paid out to someone that had been dismissed under misconduct. I understand that the 5% contribution by employee is money that rightfully belongs to him/her.
