Workplace violence is on the rise. With the shootings at the movie theater in Colorado, this timely topic is important for every organization. No one ever thinks the worst will happen until it does. The best course of action is to have a plan of action – even if you never use it.

Jenna Bedsole, Shareholder of Baker Donelson, Bearman, Caldwell & Berkowitz PC will present on the topic of Workplace Violence: Identification, Prevention and If the Worst Happens, Evaluating Exposure. Jenna will discuss the types of workplace violence and the potential causes. Jenna will also discuss and assist in developing a comprehensive plan or strategy to address workplace violence and review current state gun laws and how they impact employers’ businesses

The following types of questions regarding state gun laws will be discussed during this session:

• Can employers ban guns completely from the workplace?

• What restrictions have states placed on keeping guns locked in personal vehicles on employers’ premises?

• Does permitting guns on company property affect insurance coverage?

OSHA plays a large part in the safety and health of employees. Thus the statute and its regulations will be reviewed.


Jenna will also discuss identification of warning signs as it is important for security. Jenna will discuss other preventative ways to keep your most valuable asset: your employees safe.

The following questions will be discussed:

• Can an employer require background checks for employees as a preventative measure without violating discrimination laws?

• Are certain businesses at higher risk and what should those businesses do differently?

Finally, Jenna will discuss what to do if the worst happens and how to evaluate an employer’s potential exposure.

• Can an employer be liable for the acts of a violent third-party?

• What responsibility does an employer have if one of its own employees turns violent?

These questions and more will be answered during this session.
