Description
With new recreational marijuana laws in Washington and Colorado, medicinal marijuana legal in over a dozen states, and drug use on the rise, employers will continue to see an increase in drug-related workplace issues over the coming months and years. This training will cover the challenges employers face in tackling workplace drug use, and drug and alcohol abuse by employees. Primary among these issues is that of developing a drug and alcohol policy, and implementing workplace drug testing procedures. What may employers include in their drug and alcohol policies? When may employers test current or prospective employees for drug use? What questions regarding drugs and alcohol are permissible to ask in job interviews? Employees will learn important distinctions between drugs and alcohol regarding policies, testing, and discipline. Other challenges presented by workplace drug use that will be explored include: employee health, workforce development, workplace safety, and impact on the business operations. In addition to reducing productivity, drug use also increases the risk of accidents or violence occurring in the workplace. This webinar will provide an overview of the key legal issues – on both a state and federal level – surrounding workplace drug use, using recent and relevant case law. Key differences between public and private employers regarding permissible testing will also be discussed. Finally, the presentation will explore the components of a good substance abuse policy, and best practices for enforcing such a policy.
