CIS ACKNOWLEDGES UNUSED H-1B CAP NUMBERS, ABOUT 45,000 OVER FOUR YEARS

On September 17, 2012, the Citizenship and Immigration Service (CIS) responded to a Freedom of Information Act request for H-1B usage information over the preceding years. The government’s response has stunned the immigration community. According to data released, approximately 45,000 H-1B cap numbers have gone unused in the past four fiscal years due to apparent mismanagement of the annual H-1B quota by the CIS.

The CIS has acknowledged that there are H-1B numbers that have been unallocated for FY-2013, which runs from October 1, 2012 through September 30, 2013. While it seems clear that the quota may not have been reached, the CIS has not yet indicated what action the CIS will take, or whether the currently closed quota will be reopened to accept new petition filings.
